Abstract

Verification is an essential professional responsibility of notaries in ensuring the authenticity and legality of civil transactions. In notarial practice, verification has become increasingly important because of the growing prevalence of forged documents, fraudulent conduct in real estate transactions, and difficulties in determining legal capacity, personal identity, and the legal status of assets involved in transactions. Nevertheless, current verification practices remain subject to several limitations, including the absence of uniform regulations governing verification procedures and ineffective mechanisms for coordination and information sharing. Based on an analysis of relevant legal provisions, their practical implementation, and the experience of France, this article proposes measures to improve the legal framework by standardizing verification procedures, enhancing access to and utilization of databases, and strengthening coordination mechanisms in notarial practice. These measures are intended to improve legal certainty and safeguard civil transactions in the context of digital transformation.
