Abstract

Special investigative measures are a new legal institution introduced by Vietnam’s 2015 Criminal Procedure Code to meet the requirements of crime prevention and control in the new context. These measures can affect human rights, particularly the right to privacy, which is recognized and protected under Vietnamese law. This article clarifies Vietnamese legal provisions on privacy and analyzes how special investigative measures may impact this right in practice. It also presents viewpoints aimed at promoting a more unified understanding and interpretation of the 2015 Criminal Procedure Code provisions on special investigative measures, thereby strengthening the protection of privacy during their application.
