Abstract

Personal interests constitute an important category of legal relations governed by civil law and are closely associated with human rights recognized, respected, and protected under national and international law. However, such rights are generally established on the basis of a living individual. This raises the question of whether personal rights and interests completely cease upon death or whether certain values continue to exist and require legal protection. This article examines the issue from the perspective of Vietnamese civil law, focusing on identifying, analyzing, and classifying the categories of personal interests of deceased persons that should continue to be protected. On that basis, the article clarifies the legal grounds, scope, and limitations of the current protection mechanism. Through an assessment of the existing legal framework, the article identifies several remaining gaps and proposes recommendations for improving the protection of personal interests after death, thereby contributing to the protection of human rights and aligning with the development orientation of Vietnamese law.
