Abstract
Detention in urgent circumstances is a special preventive measure that directly interferes with an individual’s right to personal liberty. It is applied to promptly prevent criminal conduct, prevent offenders from fleeing, and prevent the destruction of evidence. The Criminal Procedure Code provides three statutory grounds for the application of this measure. However, the interpretation and practical application of these grounds continue to raise issues that require further clarification, particularly with respect to determining whether a person is preparing to commit a crime and relying on the identification or confirmation of persons who witnessed the criminal act. This article analyzes the legal grounds for applying detention in urgent circumstances and further clarifies the political, legal, and professional requirements that should be observed in its application.
