Abstract

This article analyzes property disputes between spouses upon divorce in cases where they cohabit with their families, as regulated by the Law on Marriage and Family 2014. The discussion categorizes cases into two primary situations: when the spouses' property can be identified within the family's common property and when it cannot. In addition to examining current legal provisions, this article presents practical examples from adjudicated court decisions. Based on this analysis, the author proposes solutions to improve the law and ensure fairness and protection of rights in the division of property upon divorce.
