Abstract

Along with the rapid development of the real estate market in Ho Chi Minh City, disputes and legal risks arising from land use right transfer transactions have increasingly grown in both quantity and complexity. Judicial and administrative practice reveals several legal shortcomings relating to transfer conditions, contract validity, notarization, land registration procedures, determination of land users’ rights, and dispute settlement mechanisms. This article analyzes the current legal framework governing individual land use right transfers from the practice in Ho Chi Minh City, identi'es existing limitations in law enforcement, and proposes recommendations to improve the legal system and enhance legal certainty in land transactions.
