Abstract
In the context of international integration, ensuring the rights of children in civil relations involving foreign elements is an important requirement in Vietnam. This article analyzes the current legal provisions on the eligibility requirements for parties to intercountry adoption under the 2010 Law on Adoption. By comparing Vietnamese law with the 1993 Hague Convention, the article identifies several shortcomings concerning the age requirements for prospective adoptive parents, criteria relating to the circumstances of children eligible for adoption, and the compatibility of provisions on specified-child adoption with the principle of subsidiarity. On this basis, it proposes recommendations for improving the relevant legal framework. The study contributes to better ensuring the best interests of the child and enhancing the effectiveness of international judicial cooperation.
