Abstract

Childbearing is an important aspect of family life; however, some women are unable to carry a pregnancy and give birth. Altruistic gestational surrogacy is an important legal institution that was formally recognized for the first time under Vietnam’s 2014 Law on Marriage and Family, thereby creating an opportunity for infertile married couples to become parents with the assistance of a gestational carrier. This article examines the legal requirements applicable to gestational carriers under Vietnamese law and compares them with relevant regulations in selected jurisdictions. On this basis, the article identifies certain limitations in the current legal framework and proposes recommendations for improving the law governing eligibility requirements for gestational carriers in Vietnam.

Keywords: Altruistic gestational surrogacy, eligibility requirements, gestational carriers.
