Abstract
Against the backdrop of international integration and the growing need to improve workforce quality, foreign investment in higher education plays an important role in Vietnam’s development. This article examines the legal framework governing such investment under the 2025 Law on Investment, the 2025 Law on Higher Education, and current implementing regulations, and compares this framework with Vietnam’s international commitments on educational services. The analysis identifies several shortcomings, including overlapping legal provisions, complex administrative procedures, investment requirements that are difficult to meet in practice, and inconsistent arrangements for the organization and management of foreign-invested educational institutions. To address these shortcomings, the article proposes reforms to strengthen legal consistency, simplify administrative procedures, refine investment requirements, and improve the effectiveness of state oversight of foreign-invested higher education institutions.
