Abstract
The rapid development of e-commerce has led to an increase in disputes arising in the digital environment, particularly those involving cross-border transactions. This article analyzes the current state of online dispute resolution (ODR) mechanisms in Vietnam and examines the experience of the United Nations Commission on International Trade Law (UNCITRAL) and the European Union (EU). Based on this analysis, the article proposes several measures to improve the legal framework, establish a national ODR platform, strengthen regulations governing electronic evidence, and enhance the effectiveness of online dispute resolution. These measures are intended to address the evolving requirements of e-commerce and the digital economy in Vietnam.
Keywords: Cross-border disputes, e-commerce, electronic evidence, online dispute resolution (ODR).
