Abstract
In the era of globalization, there has been an increasing number of international disputes in civil and commercial matters. The parties involved may submit their case to courts in two or more countries. To avoid the risk of different courts adjudicating the same case and rendering contradictory judgments, many countries, particularly in the European Union, have applied the doctrine of lis pendens, allowing courts to decline international jurisdiction under certain circumstances. This article clarifies the content and purpose of the lis pendens doctrine in the refusal of international civil jurisdiction and examines its application within the European Union. Based on this analysis, the article proposes recommendations for improving Vietnamese law regarding the declining of international civil jurisdiction based on the lis pendens doctrine.
Keywords: Lis pendens, declining jurisdiction, international civil disputes, European Union, Vietnam.
