Abstract
This paper analyzes the legal impediments encountered in the resolution of credit agreement disputes in Vietnam, stemming from the crucial market-regulating role of credit and the existing asymmetry in legal standing between credit providers (lenders) and borrowers. This asymmetry leads to difficulties in dispute resolution and constraints on the adequate protection of the parties' rights and legitimate interests, particularly those of the weaker party, owing to shortcomings in the prevailing legal framework and its practical application. The research focuses on elucidating these core legal impediments and underscores the imperative need to reform the relevant legal mechanisms to enhance effectiveness and fairness in resolving this category of disputes.
