Abstract
Artificial intelligence (AI) is playing an increasingly important role in healthcare and accelerating the digital transformation of the health sector. Although the application of AI can improve the quality and efficiency of medical examination and treatment, it also creates substantial risks to patients’ right to privacy and the confidentiality and security of their health information. This article examines the provisions of Vietnamese law governing the application of AI in healthcare, with particular emphasis on the protection of patients’ privacy, personal data, and health information. On this basis, the article identifies limitations in the existing legal framework and proposes recommendations for its improvement. These recommendations seek to strengthen the protection of patients’ privacy and health information while ensuring an appropriate balance between the promotion of technological innovation and the safeguarding of patients’ fundamental rights.
