Abstract

A notarial deed of verification (vi bằng) records actual events or conduct, thereby enabling individuals, agencies, and organizations to proactively establish evidence, prevent disputes, and protect their lawful rights and interests. Effective from 1 July 2026, the 2025 Law on Civil Judgment Enforcement and Decree No. 151/2026/ ND-CP establish a new regulatory framework governing civil judgment enforcement offices, enforcement officers, and the preparation of notarial deeds of verification. In parallel, Decree No. 109/2026/ND-CP provides a system of administrative sanctions for violations in this field. This article examines state management of notarial deed of verification activities from the perspectives of law-making, regulation of professional service providers, oversight of professional practices, database administration, record retention, inspection, examination, and the handling of violations. The findings indicate that the new regulatory framework enhances transparency, promotes digital transformation, and addresses several shortcomings of the previous registration mechanism. Nevertheless, legal and institutional gaps remain with respect to technical standards for electronic notarial deeds of verification, risk-based post-inspection, inter-agency coordination, personal data protection, and liability for compensation. On this basis, the article proposes recommendations for improving the relevant legal framework and enhancing the effectiveness of its implementation.
