Abstract

This article examines the procedures for resolving petitions for the recognition of consensual divorce and agreements on child custody and property division in selected jurisdictions with representative legal systems, including China, Finland, and France. Based on a comparative analysis, the article draws lessons for Vietnam and proposes several directions for improving Vietnamese law. These recommendations aim to enhance the effectiveness of consensual divorce proceedings, better protect the lawful rights and interests of the parties—particularly those of children—and contribute to judicial procedural reform and the improved performance of courts.
