Abstract

The expropriation of agricultural land is a significant aspect of land administration and use, closely associated with socio-economic development and the protection of national and public interests. The 2024 Land Law, together with its implementing guiding documents, introduces substantial amendments to the legal framework on compensation, support, and resettlement when the State expropriates agricultural land, with the aim of strengthening the lawful rights and interests of land users. Based on an analysis of the new provisions of the 2024 Land Law on compensation principles, forms of compensation, determination of specific land prices, and policies for stabilizing livelihoods and production for affected land users, this article examines current enforcement in practice. The findings indicate that although the legal framework has become more market-oriented and fairer for land users, major implementation challenges remain, particularly in determining land prices, allocating land for compensation, and ensuring sustainable livelihoods after expropriation. On that basis, the article proposes recommendations to improve the effectiveness of applying the law on compensation for agricultural land expropriated by the State in the coming period.
