Abstract

This article focuses on researching current legal regulations regarding the crime of bribing or coercing others in making declarations or providing documents. Based on a comparison of the provisions in Article 384 of the current Penal Code with relevant provisions in the current Criminal Procedure Code and Ordinance 02/2022/ UBTVQH15, amended and supplemented in 2025, on administrative penalties for obstructing judicial proceedings, the author points out several legal gaps and limitations in the technical presentation of this article. From this, the author proposes several recommendations to improve the technical presentation and content of Article 384 of the current Penal Code, ensuring the consistency and clarity of the legal document. The recommendations relate to amending the law or issuing guiding documents to resolve misunderstandings and help judicial bodies apply this article accurately and consistently in practice.
