Abstract
In the context of digital transformation, commercial relations are increasingly conducted in the online environment, leading to a rise in both the number and complexity of disputes. Online Dispute Resolution (ODR) is considered a suitable mechanism for addressing such disputes due to its flexibility, cost-effectiveness, and time efficiency, which align with the characteristics of modern commercial transactions. However, the current Vietnamese legal framework has yet to establish a comprehensive, coherent, and effective system governing ODR. This article analyzes the theoretical foundations of ODR, examines the current legal framework and its practical implementation in Vietnam, and proposes orientations and solutions to improve the legal system in this field in order to meet the demands of the digital economy.
