Abstract

In the context of digital transformation in general, and digital transformation in international trade in particular, smart contracts have emerged as an inevitable and objective development, keeping pace with the growing application of advanced technologies and creating significant breakthroughs not only for businesses but also for governments worldwide. However, most jurisdictions, including Vietnam, have not yet established a comprehensive legal framework governing this type of contract. This regulatory gap creates considerable challenges when disputes arising from smart contracts occur in the sphere of international trade. Against this background, the article provides an overview of smart contracts and focuses on examining international experience as well as the current Vietnamese legal framework governing the resolution of disputes arising from smart contracts concluded in international trade. On that basis, the article offers several recommendations and proposes directions for improving Vietnamese law on the resolution of disputes arising from such contracts.
