Abstract

When a person passes away, does their presence truly come to an end? With the development of arti'cial intelligence (AI), individuals may continue to exist as a “digital replica” even after death. Presented as a humanitarian tool that helps relatives maintain a sense of connection and cope with loss, griefbots nevertheless raise a range of legal and ethical questions: whether the collection and processing of the personal data of the deceased are conducted on a lawful basis; the extent to which the wishes of the deceased are respected; and how the liability of service providers should be determined when this technology may profoundly aKect users’ emotions, behavior, and private life. These issues will be the focus of analysis and clari'cation in this article.
