Abstract

This article examines the provisions of Vietnamese civil procedure law concerning the transfer of civil cases. Based on an analysis of the 2015 Civil Procedure Code, in conjunction with practical application and references to the legislative experiences of several foreign jurisdictions, the article identi'es a number of shortcomings in the current legal framework, including the absence of speci'c provisions on time limits for transferring cases, the authority to issue transfer decisions, and mechanisms for addressing the legal consequences of case transfers. The research 'ndings indicate that improving this legal institution plays an important role in ensuring that civil cases are resolved by competent courts, protecting the lawful rights and interests of litigants, and enhancing the eRciency of judicial activities. Accordingly, the article proposes several recommendations for improving the legal framework governing the transfer of civil cases. This study contributes to the development of both the theoretical and practical foundations of the transfer of civil cases in the context of judicial reform in Vietnam.
