Abstract
This study clarifies fundamental theoretical issues and establishes a scholarly foundation for examining employment relationships involving foreign workers. Based on a synthesis of established academic perspectives, it proposes definitions of “foreign workers” and “employment relationships involving foreign workers.” The study also examines actual working arrangements, employer supervision, and workers’ dependence on employers, as identifying an employment relationship requires consideration of how work is organized and performed in practice. The findings provide a theoretical basis for further research on the working conditions of foreign workers and the protection of their rights and legitimate interests in Vietnam.
