Abstract

The article focuses on analyzing Vietnamese law on controlling collusion in bidding, a critical issue that undermines the competitiveness and transparency of the bidding process. It also highlights the challenges and obstacles in the practical enforcement of the law, arising from overlapping regulations in the Competition Law and the Bidding Law regarding their scope and sanctioning mechanisms. These overlaps create difficulties in determining jurisdiction, handling violations, and establishing effective coordination among enforcement agencies, particularly in information sharing and the role of the National Competition Commission.
