Abstract

Improving competition law in general, and the legal regulation of unfair competition in particular, has become an important trend in many countries in response to the impacts of globalization, including in Vietnam. The 2018 Competition Law and the 2025 Law on Electronic Commerce have established a fundamental legal framework for regulating unfair competition practices in the e-commerce sector. However, practical implementation has revealed a number of legal gaps and enforcement challenges. This article examines several fundamental theoretical issues concerning unfair competition and assesses the regulation and manifestation of unfair competition practices on digital platforms in Vietnam. On that basis, it proposes several recommendations aimed at improving the relevant legal framework and enhancing the effectiveness of law enforcement.
