Abstract

Divorce is the result of a process of struggle and the pursuit of happiness, which not only directly aKects the primary subjects of the marital relationship, namely the husband and wife, but also signi'cantly impacts their common children, particularly those who are still minors. The article evaluates the current practice of resolving child custody disputes and identi'es several shortcomings, including the qualitative nature of criteria for assessing child-rearing conditions, the limited eKectiveness of obtaining children’s opinions, and the negative psychological impacts of divorce on children. On that basis, the author proposes several recommendations aimed at improving the legal framework and enhancing the protection of children’s rights in the settlement of post-divorce child custody disputes.
