Abstract

The right to freedom of business plays a particularly important role in a market economy, serving as a prerequisite for the development of business entities and a driving force for economic growth. In Vietnam, along with the process of reform and international integration, the thinking on the right to freedom of business has undergone fundamental changes, gradually being recognized and guaranteed within the legal system. However, in practice, the exercise of the right to freedom of business still faces many legal and administrative obstacles. This article analyzes the constitutional basis, legal content, legal limitations, and practical aspects of guaranteeing the right to freedom of business as stipulated in current Vietnamese law. Based on this analysis, it proposes several recommendations to improve the law in the context of market economic development and international integration.
