Abstract

In the context of increasingly diverse and complex credit activities, disputes arising from credit contracts brought before the Courts have shown a growing trend in both quantity and legal complexity. Judicial practice indicates that many legal risks stem from the process of entering into, performing, and handling credit contracts, such as violations of conditions for the validity of transactions; risks related to secured assets; disputes over interest rates and repayment obligations; violations concerning representation and signing authority; as well as shortcomings in bad debt settlement activities. This article analyzes common legal risks in credit contracts through court trial practice, while also proposing several recommendations aimed at improving the legal framework and enhancing the eKectiveness of law enforcement in the banking and credit sector.
