Abstract
This article examines the legal liability of businesses using artificial intelligence (AI), focusing on risks involving personal data and consumer rights and the determination of liability when AI systems cause harm. Drawing on the European Union’s experience with risk-based AI governance, preventive obligations, and record-keeping requirements, the article recommends that Vietnam improve its regulations on compensation for damages, clarify the allocation of liability among relevant parties, and strengthen oversight of high-risk AI systems.
