Abstract
The Law on Juvenile Justice 2024 establishes, for the first time, a comprehensive legal framework governing diversion measures in Vietnam, reflecting a shift in criminal justice policy toward education, rehabilitation, and community reintegration. This article analyzes the legal provisions governing diversion measures and identifies several challenges and shortcomings in their implementation, including the continued application of diversion within the framework of criminal proceedings, inadequate and inconsistent implementation conditions, and the absence of a mechanism for evaluating effectiveness. Drawing on the experience of selected countries, the article proposes recommendations for improving Vietnamese law and enhancing the effectiveness of diversion measures for juvenile offenders.
