Abstract

Online trials were introduced in Vietnam during the COVID-19 pandemic. Beyond responding to an immediate public health crisis, however, they represent an essential requirement and an inevitable development in the digital transformation of the judicial system toward the establishment of electronic courts (Nguyen Hoa Binh, 2023). Online trials of administrative cases are particularly significant for courts, citizens, and state administrative authorities. This article examines the legal framework governing online trials of administrative cases in Vietnam, the statutory conditions under which such cases may be adjudicated online, and the rights and obligations of participants in online proceedings. Based on this analysis, the article proposes several recommendations for improving Vietnam’s legal framework governing online trials of administrative cases.
